We at Premise Data Corporation (“Premise”) know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn about personal information that is collected, used and shared by us. Any capitalized terms we use in this Privacy Policy without defining them have the definitions given to them in the Terms of Use: https://premise.com/tos/.

By using or accessing the Service, including using our website, portals or platforms in any manner or downloading our mobile apps, reviewing or completing Tasks (as described in the Terms of Use) and signing up for the Premise Wallet, you accept the practices and policies outlined in this Privacy Policy, and you consent to our collection, use and sharing of your personal information in the ways listed below.

Understand Your Role With Us

Premise uses the terms “Customer”, “Contributor”, and “Visitor” in this policy to describe the different roles in relation to Premise and its services and environment. These roles are defined as follows:

  • Customer: If you are someone who executes a Master Services Agreement or other client agreement with us (a “Customer Agreement”) (or an employee/consultant of a company that has executed such a Customer Agreement with us and you are accessing the Service in your employment/consultant capacity), or who is expressly authorized by Premise to access one of our online client-specific portals or platforms, you are referred to in this Privacy Policy as a Customer.
  • Contributor: If you download our mobile applications, you are referred to in this Privacy Policy as a Contributor.
  • Visitor: Everyone else is referred to as a Visitor.

The terms in Part I of this Privacy Policy apply to Customers, Contributors and Visitors. The terms in Part II apply if you are a Customer.  The terms in Part III apply if you are a ContributorThe terms in Part IV apply to Contributors and Visitors who are California residents and, after January 1, 2023, also to Customers who are California residents.

PART I – TERMS FOR EVERYONE – CUSTOMERS, CONTRIBUTORS AND VISITORS

This Privacy Policy applies to the Premise apps, websites, platforms, and products and services available on or at the apps, websites or other online portals. Premise collects information about you when you install our mobile application and through other interactions and communications you have with us through our online services (including our website, portals and platforms) or otherwise. Remember that your use of the Service is at all times subject to the Terms of Use, which incorporates this Privacy Policy. The Service is owned and operated by Premise, and this Privacy Policy applies to information collected and used by Premise.

We may transfer the information described in this Privacy Policy to, and process and store it in, the United States, which may have a lower level of data protection laws than your country of residence. Where this is the case, we will take appropriate measures to protect your personal information in accordance with this Privacy Policy and applicable laws.

We are constantly trying to improve the Service. We may change this Privacy Policy from time to time as well. We will alert you to changes by sending you an in-app message, posting a notice on relevant social media platforms, posting the updated Privacy Policy on our website, platforms, portals and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Service, and you are still responsible for reading and understanding them. If you use the Service after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy that is in effect at the time the information is collected.

SCOPE AND APPLICATION

This Privacy Policy applies to persons anywhere in the world who access or use any of the Services.

We do not knowingly collect or solicit personal information from anyone who is under the age of 18 years, or the age of majority where that individual resides or is located when using the Service, whichever is lower (collectively, the “Age Minimum”). Please do not attempt to use the Service or send any personal information about yourself to us if you are younger than the Age Minimum, and please do not send any personal information about anyone else who is under the Age Minimum or under 13 years of age, whichever is lower. If we learn that we have collected personal information from someone under the Age Minimum or 13 years of age, whichever is lower, we will delete that information as quickly as possible. If you believe that a person under the Age Minimum may have provided us personal information, or if we have been provided personal information about someone who is under the Age Minimum of 13 years of age, whichever is lower, please contact us at [email protected].

COLLECTION AND USE OF INFORMATION

Information We Collect Through Your Use of the Service

We collect information about how you interact with the Service, preferences expressed, and settings chosen. In some cases, we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers. Through cookies we place on your browser or device, we may also collect information about your online activity after you leave the Service. This information allows us to improve the Service and customize your online experience, and otherwise as described in this Privacy Policy.

We also collect information you provide directly to us, as well as information you provide through use of third-party accounts.

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. The Service does not support browser “Do Not Track” requests at this time, which means that we collect information about your online activity both while you are using the Service and after you leave the Service. By using our Service, you expressly consent to this collection of information.

Google, Bing, and social media ads, and any other similar vendors with which Premise works, may collect or receive personally identifiable information about your online activities over time and across different websites from the Service and other apps, and use that information to provide measurement services and ads. By using the Service, you agree to the collection and use of information for ad customization. You can opt out of Google Analytics by using the following add-on https://tools.google.com/dlpage/gaoptout/.

We use analytics to help analyze how our users use the Service. Google Analytics uses cookies to collect information such as how often our users visit the Service, what pages they visit, and what other sites they used prior to coming to the Service. We may use the information we get from Google Analytics to improve our Service or to send you promotional messages about our Service. Google Analytics collects the IP address assigned to you on the date you visit the Service, but not your name or other personally identifying information. We do not combine the information generated through the use of Google Analytics with any personally identifying information. Although Google Analytics plants a persistent Cookie to identify you as a unique user the next time you visit the Service, the Cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Service is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Where we are required to seek your consent to the use of non-essential cookies under applicable laws, we seek this consent through our cookie management tool.

RETENTION OF INFORMATION

We will only retain your personal information for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

EUROPEAN DATA PROTECTION

Under applicable European data protection laws (subject to the rights and exemptions under such applicable laws), European users have rights to: (i) check whether we hold personal data about them and to receive a copy of their personal data; (ii) request the correction of their personal data that is inaccurate; (iii) request the erasure of their personal data; (iv) request the restriction of the processing of their personal data; and (v) raise a data processing concern with their local supervisory authority. In certain circumstances, they also may have the right to object to legitimate interest processing of their personal data in accordance with the applicable data protection laws. Further, they have the right to transfer certain of their personal data to third party providers of services under the data portability right. PART II – ADDITIONAL TERMS FOR CUSTOMERS

In addition to the terms in Part I above, the terms below in this Part II apply to our Customers.

If there is any conflict between the Customer Agreement applicable to you and this Privacy Policy, then the terms of that Customer Agreement shall control to the extent legally permissible and during the term that such Customer Agreement is in effect.

COLLECTION AND USE OF INFORMATION

Premise browser apps for Customers collect data and metadata related to login, authentication, and account information. Sentry, Amplitude and FullStory, and any other similar vendors with which Premise works, may collect or receive personally identifiable information about your online activities over time and usage of the Premise customer apps. This information is only used to improve the Premise apps for Customers and is not sold or shared with third parties.

Sales information, communication, and collaboration data is collected in approved financial and communication systems such as Salesforce, Google Workspace, and Microsoft 365, and other approved systems that are private and isolated, with access to only approved Premise employees.

PART III – ADDITIONAL TERMS FOR CONTRIBUTORS

In addition to the terms in Part I above, the terms below in this Part III apply to our Contributors.

Premise mobile apps are tools to collect data about the world around you. By downloading one of the Premise apps or signing up for the Premise Wallet, you consent to the collection, use and sharing or sales of your personal information as described in this Privacy Policy.

COLLECTION OF INFORMATION

The following lists some of the data we collect and why. We provide more information about the personal information we collect in the next section of this Privacy Policy.

Collection of app names To minimize the risk of fraud by making sure the user is not using an app that doctors information that is key for the effective functioning of the app, e.g.: location data, clock, etc., and for the compilation of accurate information for our clients and affiliates.
Battery status To understand the impact of our app on the user’s battery, and for monitoring and detecting fraud.
WiFi and Cellular To better understand the quality of the signal on the user’s device and thereby help our partners improve network coverage, as well as reactively providing a better service for users based on signal quality.

If you sign up for the Premise Wallet, we also collect your:

  • Premise User ID
  • Premise Wallet ID
  • PrimeTrust Contact ID
    Country and region code for the account
  • Full name
  • Date of birth
  • Phone number
  • Tax ID
  • Address
  • Photos of a government ID
  • Photos of proof of address document
  • Photo of you
  • External crypto wallet address (if you are depositing or sending money externally)
To identify you, to manage, maintain and operate the Premise Wallet service and your Premise Wallet account, to minimize the risk of fraud, to comply with government regulations, to satisfy “Know Your Customer” requirements, to facilitate background checks, to facilitate payments to you, to verify your identity and the identity of any external crypto wallet address, and to facilitate cryptocurrency transactions.

Overall, we will be logging the data mentioned above in order to better serve our users and prevent fraudulent users from abusing our Services, including the Tasks for which we pay users, and to fulfill projects for clients and affiliates. This data will be sent to Premise via Amplitude, a third-party analytics company. Some of the information mentioned above may also be shared with our partners, clients and affiliates.

Information You Provide to Us

We collect information you provide directly to us, as well as information you provide through use of third-party accounts. We collect information when you create or modify your account, complete a task, contact customer support, or otherwise communicate with us. This information may include name, social media account, email address, phone number, payment identifier, and other information you choose to provide. We also collect any images, videos or recordings that you submit to us, including photos, screen shots and audio recordings.

Information We Collect Through Your Use of the Service

When you use the Service, including the Premise Wallet if you sign up for it, we collect information about you in the general categories below:

Location Information: When you use the Service to complete Premise Tasks, we collect precise location data that tracks your check-in location and observation locations. If you permit the Service to access location services through the permission system used by your mobile operating system (“platform”), we may also collect the precise location of your device when the app is running in the foreground or background. We may also derive your approximate location from your IP address.

Contacts Information: If you permit the Service to access the address book on your device through the permission system used by your mobile platform, we may access and store names and contact information from your address book for account verification, and also for referrals and similar usages.

Power Information: If you permit the Service to access your power information on your device through the permission system used by your mobile platform, we may access and store your power levels and charging status to understand the environment our product operates in.

Transaction Information: We collect transaction details related to your use of the Service including your payment information, the payment provider you use, the date and time a Task was completed, submitted, reviewed and paid, a cash out was initiated, the amount of money made, and other related transaction details.

Device Information: We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.

Log Information: When you interact with the Service, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with the Service. We may also collect internet and other online activity, including browser information and history, cookie information (pursuant to your cookie preferences, if any), and time stamps.

Information We Collect from Other Sources

If you provide your third-party account credentials to us or otherwise sign in to the Service through a third-party site or service, you understand some content and/or information in those accounts (“Third-Party Account Information”) may be transmitted into your Premise account if you authorize such transmissions, and that Third-Party Account Information transmitted to the Service is covered by this Policy. We may combine information from this app or site with information we have collected from you in your capacity as a user of the Service.

Google, Branch, Leanplum, Amplitude and FullStory, and any other similar vendors with which Premise works, may collect or receive personally identifiable information about your online activities over time and across different websites from the Service and other apps, and use that information to verify tasks and surveys, detect fraud, and provide measurement services and ads.

Premise takes fraud prevention and legal compliance seriously. As a condition of being qualified to sign up for and complete Tasks using the App, Premise may conduct background and security checks, as it deems appropriate and in its sole discretion.

Important Information About Platform Permissions

Mobile platforms have defined certain types of device data that apps cannot access without your consent. These platforms have different permission systems for obtaining your consent. Android devices will notify you of the permissions that the Premise app seeks before you first use the app, and your use of the app constitutes your consent.

USE OF INFORMATION

We may use the information we collect about you to:

Provide, maintain, and improve the Service, including the Premise Wallet if you sign up for it, including, for example, to facilitate payments, provide products and services you request (and send related information), develop new features, provide customer support to users, authenticate users, and send product updates and administrative messages;

Perform internal operations, including, for example, to prevent fraud and abuse of the Service, including the Premise Wallet if you sign up for it; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;

Send or facilitate communications between you and our internal support system, such as important notifications pertaining to a subset of app users;

Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of Premise and other companies, where permissible and according to local applicable laws; and to process contest, sweepstake, or other promotion entries and fulfill any related awards; and

Personalize and improve the Service, including the Premise Wallet if you sign up for it, including to provide or recommend features, content, referrals, and advertisements.

The legal basis for us using your personal information for contractual or legal purposes where we need it to provide the Services, including the Premise Wallet if you sign up for it, or operate the website or for our legitimate interests, including our general business and marketing activities, for investigations or disputes purposes and for promotional purposes. Where we rely on legitimate interests as the basis for processing your personal information, under applicable laws you may have a right to object to this processing.

SHARING OF INFORMATION

We may share or sell the information we collect about you as described in this Privacy Policy (including the Premise Wallet if you sign up for it), or as described at the time of collection or sharing, including as follows:

With Premise partners and affiliated entities that provide services or conduct data collection and/or data processing on our behalf, or for data centralization and / or logistics purposes;

With Premise clients that engage Premise to gather data, images, recordings and videos, including photos, screen shots and audio recordings, in locales around the world;

With vendors, consultants, business advisors, marketing partners, auditors, professional advisors such as financial or legal advisors and other service providers who need access to such information to carry out work on our behalf or provide advice or a service to us;

In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process, including to respond to subpoenas, search warrants and court orders;

To establish or exercise or legal rights, or to defend against legal claims;

To investigate, prevent, or take action regarding alleged or actual illegal activities, violations of the Terms of Use, or as otherwise required by law;

To comply with applicable laws, including laws pertaining to taxes;

To administer a promotion or survey;

With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our Terms of Use or other relevant policies, or to protect the rights, property, or safety of Premise or others;

In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;

If we otherwise notify you and, where required, you agree to the sharing; and

In an aggregated and/or anonymized form which cannot reasonably be used to identify you.

Analytics and Advertising Services Provided by Others

We may allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you use the Service, as well as when you visit other online sites and services.

YOUR CHOICES

Account Information

You may correct your account information at any time by logging into your in-app account. If you wish to cancel your account, please email us at [email protected]. Please note that in some cases we may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if you have a standing credit or debt on your account, or if we believe you have committed fraud or violated our Terms of Use, we may seek to resolve the issue before deactivating your account.

Access Rights

Premise will comply with individual’s requests regarding access, correction, and/or deactivation of a user’s account or other personal information about the individual in accordance with applicable law.

Location Information

The Service, including the Premise Wallet if you sign up for it, requests permission to collect precise location from your device per the permission system used by your mobile operating system. Disabling collection of this information will limit your ability to access the Service. However, disabling the Service’s collection of precise location from your device will not limit our ability to collect your location information from your IP address.

PART IV – CALIFORNIA RESIDENTS

The following provisions apply to Contributors and Visitors who are California residents and, after January 1, 2023, to Customers who are California residents.

Right to Know. You may request that we provide you a list of the categories of personal information we have collected about you over a specified period of time (controlled by law), the categories of sources from which it was collected, the business or commercial purpose for collecting or selling the information, and the categories of third parties to whom we disclosed or sold that information. You may also request that we provide you a copy of the specific pieces of personal information we have collected about you over a specified period of time (controlled by law). You may make a request to know up to two times in a 12-month period, subject to limitations described in the law. For a list of general categories of information that we have collected and shared in the past 12 months, see the Privacy Policy provisions above. The foregoing does not apply to personal information exempted under the California Privacy Protection Act (“CPPA”) or the California Privacy Rights Act of 2020 (“CPRA”).

Right to Delete. You may request that we delete any personal information that we have collected from you, with the exception of information that the law allows us to keep. When we respond to your request to delete, we will explain what (if any) information we have kept and why. The foregoing does not apply to personal information exempted under the CCPA or the CPRA.

How to Make a Request to Know or Delete. You may make a request to know or delete by emailing [email protected]. When you make a request, we will take steps to verify your identity before responding. This is to protect your information. We will ask you to provide us your email address. If you maintain an account with us, these must match the address connected to your account.

Authorized Agent. You may designate an authorized agent to make requests on your behalf. We will require verification that you did, in fact, authorize the agent. Unless the law requires otherwise, your authorized agent must provide contact details for you. We will contact you to confirm that you authorized the agent. Once you confirm, we will promptly respond to the rights request.
No Sales of Personal Information Without Consent. We do not sell personal information of Visitors or Customers. We may sell personal information of Contributors to third parties with your consent and only as described in this Privacy Policy.

Right to Request Information About Disclosure to Third Parties for their Direct Marketing Purposes. You may request information about our disclosure of personal information to third parties or affiliated companies for their direct marketing purposes. To make such a request, please email us at [email protected]. Please allow up to 30 days for us to process your request. You may submit such a request once per year.

Non-Discrimination. You have the right to be free from discrimination for exercising your rights.
